Many of us take it for granted that we need an attorney when we buy or sell property, but there is actually no legal requirement for us to do so. When you come across a problem buying or selling property, however, this is when you really value having a real estate attorney on board.
So here are 4 reasons why you will be very happy you have a real estate attorney looking after your interests on your next property deal.
Property Lawyers Can Protect Your Rights
Most of us have some idea of our legal rights when we buy or sell property, but this is a real estate lawyer’s bread and butter. They know to the very last letter, exactly what your rights are and they will enforce them, if necessary. This lifts a huge weight off your shoulders, just knowing that you have someone battling for you, if everything turns bottom up.
Property Lawyers Understand Property Law
Your real estate lawyer knows all of the title searches that need to be performed to ensure that the person selling the property has the legal right to do so. They also know all of the legal documents that have to be collected, completed, signed and submitted on time. This is a massive undertaking for most people and a huge learning curve, which isn’t necessary if you engage an attorney.
Property Lawyers Can Save You Money
If the deal falls through and the buyer or seller pulls out or if the seller doesn’t reveal certain problems with the property, then it is important to have an attorney on your team. They can save you lots of money which you could otherwise spend on hiring a brand new attorney and bringing them up to speed on your case. An attorney who is with you throughout the selling or buying process, is the person you need to turn to when problems rear their ugly head, before or after settlement.
Property Lawyers Can Fast Track the Settlement Process
With access to online technology, real estate attorneys can now fast track the entire settlement process, using the new data insolvency software. This helps lawyers to keep track of all the required documents, allows multiple people to access these documents, to complete and sign them and keeps them all in one place. This means that no-one has to keep chasing up documents or people anymore and the whole settlement process can be completed in a matter of weeks, rather than months.
So when you next hire a real estate attorney for your property deal, make sure they are using the new data insolvency software and your deal will be completed in no time at all.
I sold my house without having a real estate attorney. But, the next time I sell a house, I would definitely hire an attorney to protect my rights and help me save more money.
Attorneys are usually well connected with a lot of companies and rich people.
They know where the money is, they have the contacts and they surely know how to close a deal, so offering an attorney a good commission on the sale can actually get you a better deal selling a property.
Also, people usually trust their attorneys, unlike real-estate agents where everybody just assumes they’re trying to rob you.
Pauline, will a real estate attorney by chance be able to negotiate the conveyancing costs of a home or land? I ask that because later today my wife will be accompanying me to look at the homes near her parents neighborhood. Also, we’re in need of doing that now that our house has been put up for foreclosure.
Whenever I enter into a venture that involves other people, I am super concerned about protecting myself. It just seems to me that it is a good idea to get a lawyer to help you in any venture you take with other people. Lawyers know the ins and outs of the law and can get you a better deal than you’d ever get yourself. Even if you’re just buying or selling real estate.
When it comes to real estate it is always a good idea to hire a real estate lawyer. It really is true that they understand your rights and can help you protect them. They are also good to have because they can answer any questions that you may have about property in a legal sense. That can definitely be useful when it comes to both buying and selling.
These are all really great reasons for why having a property lawyer is important. I have been looking for a home for a while, and I have finally decided which one I am going to buy. It would probably be really good for me to get a lawyer, because then I can get help understanding everything and getting help protecting my rights. It would also be good for me to have help tracking the settlement process. That way, we can keep track of all the documents and everything that is going on, which will help make it all go quicker. Thanks for the great post!
My wife and I are looking into buying our first house together, and I loved your tips!. We really shouldn’t worry about disappointing our agent, since we’re the ones who will be living in the house! Thanks for the tips!
I totally agree with this! I almost reached the point of bankruptcy when I started venturing into real estate way back, then I seek advice from the experts. Believe me when I say everything paid off very well! Up until now, I’m can still call this investment a success. I learned a lot from these lawyers that I started investing into stocks exchange also.
Thanks so much for this post! Property settlement can be really tricky. You’re absolutely right–real estate attorneys know what they’re doing and they’re hardly an optional accessory to the process. I’ve never really understood title searches, so I’ve always relied on a property lawyer. Thanks for sharing!
I think everyone, especially home buyers, are interested in saving money. I’m glad to see that’s one of the reasons listed in this article for hiring a real estate attorney. My husband and I will be first time home buyers later this year, and I’m nervous about all the things that can go wrong or end up costing us extra. I had thought that a realtor would take care of most of that, but now I’m going to be looking into hiring an attorney as well.
It is always a good idea to have a lawyer on hand to protect your interests. Thank you for sharing.
This is great advice for someone who has never bought a house before (yet). I have been looking for homes, and didn’t even consider getting a real estate attorney, but now that I read all of the benefits, and considering I am less than competent in my knowledge of law, I will look into it more. Especially if it can save me money!

Thank you for the post. This is really good information. I didn’t even realize the importance of having a lawyer for buying or selling your home. Having a lawyer when I was buying my first house would’ve helped me out so much. Like the article states that if the seller doesn’t reveal certain problems with the property it would be nice to know what your rights are. I’d rather spend a little on a lawyer and make sure the process is being handled correctly, then spend a lot down the road.
You have fully reached out to your readers which I like most.. i enjoy your blog and recommending this to my colleagues..
This is some really important advice for anyone planning on buying or selling a home. I have even met so many people who have have to suffer a lot later due to negligence in their paperwork.
Cheers buddy….!!!!!
Most of my investments are in Real Estate and yes i don’t know how the paper works are processed. I shall hire an attorney really soon. Thank you for you post! It means a lot.

Hi,
Glad to see such an informative post!! It really helped me a lot.
Whether you are buying or selling a residence or property, contracts and documents will be a large part of the process. These contracts can be confusing and complicated, full of legalese and unfamiliar concepts. A real estate attorney will help you understand all documents and contracts associated with a transaction. If negotiations are necessary, the lawyer will handle this process on your behalf. The attorney will also prepare and then submit or register these legal documents in accordance with local requirements.
Thanks for being sharing!!
Keep it up..

The attorney will also make sure that all the responsibilities regarding the lease have been performed. He will arrange for official documents such as security certificates.
Look online if you wish to come across a good law firm that handles real estate issues. Any good firm will definitely have its own website. Browse through the website and see the kind of facilities they are offering.

Hi,
Thanks for being sharing such an important information. I would like to add more.
Thanks for the article! I thought it was amusing that there is a chance to have illegal additions or renovations on your home. When viewing for a new home I would not have noticed specifically illegal additions that could probably hurt my budget. Having a real estate lawyer there to support what is going into the purchase of a home is quite encouraging. I really appreciate your suggestions on having a lawyer’s help. I hope to apply these tips in the future.

Thanks for pointing out that having a property lawyer will save you money if any problems arise, whether it’s before or after settlement. My son is going to be married early next year, so he and his fiance are in the early stages of looking for a home. I’ll definitely suggest that they hire a real estate lawyer so that they can smoothly deal with any problems that may come up.
Hiring a lawyer seems like a very difficult thing to do. So, I liked that you pointed out that getting a lawyer that is good can help save you money. That does seem like a good thing to be aware of when to want to not blow your budget.
Real estate attorneys are essential for due diligence
Whenever I enter into a venture that involves other people, I am super concerned about protecting myself. It just seems to me that it is a good idea to get a lawyer to help you in any venture you take with other people. Lawyers know the ins and outs of the law and can get you a better deal than you’d ever get yourself. Even if you’re just buying or selling real estate.
If you have ever been involved in a car accident, you might be familiar with the seriousness of making a good decision or saying the right thing at the right time. That is very hard to do if you are stressed or under pressure
I thought it was really interesting how the article talked about how a real estate attorney is with you throughout the entire selling or buying process so you don’t have to waste time bringing them up to speed on your case. My wife and I have been wanting to buy a brand new home that will fit us and our incoming newborn child, but we are not sure which house would be the best fit for us. It would be good to have a professional helping us throughout the entire process to ensure that we find a fair price for a new home.
I like how you mentioned that real estate lawyers know exactly what your rights are and they will enforce them. My husband just got a new job in another state, so we need to move and sell our house as soon as possible, but I have no idea how much to sell my house for. After learning about the benefits of hiring a real estate attorney, I will definitely consider hiring one to help me sell my house.

It got me when you said that lawyers can save us money. As you said, this is possible since they know the process well, so you can sell your house fast. I will definitely hire one now that I would need their help since I need the money to pay for medical bills. It’s for my cousin since he was in a bad accident which would need surgery to treat him.
Nice Blog. I personally think that a professional attorney is necessary in evry legal field like real estate, diviorce, bankruptcy etc.
I liked your comment that a real estate lawyer knows all of the property rights and will help to enforce them when selling a property. My husband and I are thinking about selling our house and we’re a bit overwhelmed. I think we should hire a professional to help us out and alleviate some of the stress!
Your story is like an inspirational movie for me. Thank you very much for sharing this.
